Liputan6.com, Jakarta - Direktur Tindak Pidana Ekonomi dan Khusus (Dirtipideksus) Bareskrim Polri Brigjen Pol Whisnu Hermawan membeberkan kronologi penetapan kembali Henry Surya (HS) dalam kasus Koperasi Simpan Pinjam (KSP) Indosurya, setelah sebelumnya divonis bebas Pengadilan Negeri Jakarta Barat (PN Jakbar).

“Tentang posisi kasus terhadap tersangka HS (Henry Surya) ini. Penyidik telah melakukan kegiatan penyidikan, di mana pada sekitar tahun 2012, saudara HS ini sebagai Direktur Utama Indosurya Finance telah mengeluarkan suatu produk perbankan, itu MTN, medium term notes atau surat utang jangka menengah,” tutur Whisnu di Mabes Polri, Jakarta Selatan, Kamis (16/3/2023).

Menurut Whisnu, kala itu dilakukan peneguran oleh regulator bahwa perusahaan tidak boleh mengeluarkan MTN tersebut. Untuk itu, Henry Surya kemudian dengan niat jahatnya seolah-olah membuat koperasi yaitu KSP Indosurya.

“Kami telah menemukan petunjuk, bukti bahwa perbuatan atau Koperasi Indosurya tersebut cacat hukum. Makanya kami terapkan saudara HS ini dengan Pasal 263 pemalsuan surat, 266 pemalsuan akta autentik, dan Undang-Undang TPPU (Tindak Pidana Pencucian Uang),” jelas dia.

Dalam upaya penetapan tersangka itu, lanjut Whinsu, penyidik telah melakukan pemeriksaan 21 saksi dan ahli, baik itu karyawan hingga notaris. Henry Surya tercatat berhasil mengumpulkan dana masyarakat yang jumlahnya kurang lebih Rp106 triliun.

“Dan di tahun 2020 ternyata gagal bayar. Dan hasil dari audit investigasi, kerugian yang menjadi dana masyarakat totalnya sekitar Rp15,9 triliun,” ujar Dirtipideksus Bareskrim Polri.

Berbeda dengan Kasus Sebelumnya

Penetapan Henry Surya sebagai tersangka kali ini berbeda dengan kasus sebelumnya, bahwa penyidik dan Jaksa Penuntut Umum (JPU) sudah berkoordinasi terkait dengan dasar aturan terlebih dahulu.

“Kalau sebuah bangunan dasarnya itu salah, pasti akan hancur. Inilah awal dari permulaan niat jahat dari saudara HS untuk mengumpulkan dana masyarakat yang totalnya sekian triliun untuk mengelabuhi dan sekarang terbukti bahwa ada korban, kerugian mencapai Rp15,9 triliun,” kata Whisnu.

Kemudian dari hasil proses penyidikan, petugas telah menemukan sejumlah alat bukti seperti dokumen, keterangan saksi ahli, petunjuk, informasi dari para penyidik, dilanjutkan dengan gelar perkara dan menetapkan Henry Surya sebagai tersangka.

“HS akan ditahan di Rutan Bareskrim 20 hari ke depan sejak tanggal 15 Maret 2023 kemarin, hingga bulan April, 2 minggu kemudian,” terang Whisnu.

Lebih lanjut, penyidik Bareskrim Polri juga masih mengembangkan aset sitaan kasus KSP Indosurya bekerja sama dengan kejaksaan. Dia berharap pihaknya dapat menuntaskan perkara yang kerugiannya mencapai triliunan rupiah itu.

“Semoga bisa menindak pelaku kejahatan dalam hal ini dengan tegas dan juga kami akan mengembalikan kepada korban,” kata Whisnu menandaskan.
